done with! and thank god for that! >> dan: countless celebrations as the u.s. supreme court makes history. good evening, i'm dan ashley. today's decision clears the way for same-sex marriages to resume in california but it sidesteps bigger question whether they have a cooling right to get married. the justices decided 5-4 that the backers of proposition 8 had no legal standing that means the lower ruling will stand. gay marriage is legal. justices also said the defense of marriage act, doma is unconstitutional. that means married gay couples living in states where their unions are legal are eligible for federal benefits just like straight married couples. joint tax returns, loan programs for veterans, pensions, health insurance benefits and family medical leave. supporters, of course, are

become the 13th stated to allow same-sex marriage. >> it's been a long wait. it's been 37 years. it's been a long journey. i feel like we almost arrived. >> this battle took off in 2004 when then san francisco mayor gavin newsom defined state and federal law ordering the county clerk to issue marriage licenses to gays and lesbians. >> the reaction has been extraordinary difficult and politicians ran away from the issue. then they started to shift in 2008, 2009 and politicians came back into the fore. it's it's been an extraordinary process. >> clouds oh the horizon for the initiative process because the justices decided prop 8 backers had no legal right to fight for the voter approved ban after state officials refused to.

prop 8 unconstitutional says it feels good to have hits decision affirmed by the supreme court. judge walker gave his first interview since the decision. >> i think any judge whose decision ultimately is affirmed or is upheld in some fashion feels a sense of satisfaction. you can understand that, i'm sure. now, this decision by the supreme court has the affect as irnlts predator by the governor now of establishing the right of same-sex couples to obtain marriage licenses in california. that probably will be litigated. >> the judge spoke with us shortly after the decision. he is in a long term same sex relationship and that became public during the

trial. sergio quintana asked the judge walk bertha. it airs tonight abc news at 11:00 over on channel 7. defenders of prop 8 are vowing to keep fighting. political reporter mark matthews has that side of story. >> in front of the supreme court, prop 8 attorney made it sound like the decision was not bad. >> it's important to understand today's ruling has completely nullified the 9th circuit's ruling against proposition 8. that was held by the supreme court. >> but more the reality that a federal court injunction has been left standing. speaking in sacramento, prop 8 organizer acknowledged as much. >> the news today is obviously the defeated of prop 8. it's been a long road. it's sad to see that our nation's laws are not functioning because of tyranny. >> he told state has famed

to support the will of people. he is referring to 2008 voted in favor of the gay marriage ban. >> the vote of the people matter anymore? does your vote count when judges strike it down? if your vote doesn't counted, we don't have a democracy any more. >> archbishop echoed that theme. he said california voters have been undermined. >> those charged elected officials to defend the laws of state can refuse to do their duty because they disagree with the law and disenfranchise 7 million voters. >> dan: supreme court rulings normally take effect in 25 days but federal appeals court says it will wait at least that long to decide whether same-sex marriages can resume in california.

this will allow backers to ask for a hearing. pamela harris said there is no need to wait. she called for the immediate listing of the stay that keep prop 8 in effect. >> each day that passes, when any individual is denied their civil liberties and civil rights, it's a sad day in our country and certainly in our state. we know that these same-sex couples have been denied equal protection under the law for far too long. >> dan: there are several california lawmakers who are deeply and personally affected by today's decision. capital correspondent nannette miranda has that part of our coverage tonight from sacramento. >> assembly speaker is the first openly gay speaker. he says it's very personal. >> this is first time in my life that i felt that the

law fully recognized he as being equal to everyone else. >> the gay, lesbian, bisexual and transgender caucus embraced as they shared the news together. they are the first openly gay married state lawmakers. their ceremonies were held during that brief period when same-sex marriages were legal. wedding plans have begun for some. >> we will not lie about who they are in state house or family house. those are things we take away from today. >> some conservative groups are upset. >> children are the victims here. next generation is going to be very confused about marriage, sex, relationships and not hear about the negative consequences. >> despite the supreme

court ruling, churches do not have to perform same-sex marriages. legislature is passed a law last year making sure that freedom stay intact. >> that no religious institution would risk the tax exempt status by not performing these marriages. >> but governor brown's department of public health says means that county clerks don't have a choice. they must comply no matter how they feel. >> you may have someone in that office who may go to his boss, i can't do this. please step aside we will find someone that will. the office has to do it. >> they are waiting for the status to be lifted and they should resume next month. >> dan: a bart strike could be imminent. what the transit agency is asking governor brown not

>> dan: developing news from arizona, an f-16 fighter jet crashed about an hour and a half in suburban phoenix. fortunately both pilots ejected safely. the base is largest f-16 training facility. the pilots are okay. the government is finding delta hiarls $750,000 for bumping passengers involuntary and not offering transportation. they say the problem is widespread. delta denies that but it is training employees in how to handle overbooked flights. >> from planes to trains, bart was back to the

insisting negotiating more security and safety for workers and passengers. if there is a strike, other transit systems have little capacity to absorb the 400,000 daily passengers and there might be a chance that it won't work. and they have also authorized a strike. >> that would leave the bay area in a pretty serious situation. >> car-pooling is recommended as the best option. >> i take bart five days a week downtown so i am hoping there is no strike. sunday night, watching the tv hoping it doesn't happen. >> the union will give as much advance notice should they decide to strike but there is no guarantee that advance notice will be. heather ishimaru, "abc 7 news." >> dan: now, bart is asking the governor not to order a 60 day cooling-off period if there is a strike. bart's president told the

governor in a letter that the strike impact would not be as bad in summer months whether people are on vacation. it would push it into september and that is one of the highest ridership months in the year and they do not want that. >> listen to this. six people were killed in fireworks and 8700 injured with fireworks setting off in the streets. they released a video showing the dangers. when somebody fires a bottle rocket that hits mannequin in the face. here a cherry bomb. if you light it in your hand and don't let it go fast enough. >> we really wanted everyone to be safe. don't buy illegal fireworks. don't make your old own homemade fireworks.
